The store is operated by the company AFRIŠKI KULTURNI CENTER, družba za izobraževanje in usposabljanje na področju kulture, d.o.o. (AKCS d.o.o.), Ulica Gorenjskega odreda 6, 4000 Kranj, registration number: 6057888000, tax number: SI 11060018. The company has been registered in the court register of the court in Kranj since the date 15. November 2011.
The General Terms are composed in accordance with the Slovenian Obligations Code, the Consumer Protection Act, the Personal Data Protection Act, and the Electronic Communications Act.
The general terms of service define the operation of the online store, the rights and obligations of the user and the store, and regulate the business relationship between the seller and the buyer. The general terms of service also regulate specific rules for purchases at the pickup locations of the company AKCS d.o.o. and are binding on the contracting parties as contractual provisions.
The buyer is bound by the General Terms, which are valid at the time of purchase (submission of an online order). Upon placing the order, the user is reminded of the general terms of service and confirms their awareness by submitting the order.
The seller reserves the right to change or supplement the general terms. The buyer is bound by the General Terms published on the website https://afrika-kc.org/pogoji-poslovanja on the order submission date.
When making a purchase, the visitor must register by entering their first and last name, email address, and delivery address, selecting the desired goods, and specifying the quantity of items. Before submitting the order, the buyer is responsible for checking the accuracy of the entered information. To place an order, the buyer must agree to these Terms of Service and click the "Order" button. The prices of the products listed in the online store include VAT.
The sales contract between AKCS d.o.o. and the buyer is concluded in the online store at the moment when AKCS d.o.o. receives the buyer’s first electronic communication upon the submission of the order form, thereby considering the order as accepted. From this moment, all prices and other conditions are fixed and apply to both AKCS d.o.o. and the buyer. By placing the order, the contract is deemed concluded, and the buyer is prompted to make the payment.
The buyer is the person whose information is provided at the time of order submission. It is not possible to change the buyer's information afterward. The sales contract (i.e., the first electronic message regarding the order status) is stored electronically on the AKCS d.o.o. server.
AKCS d.o.o. offers the following payment methods:
- by bank transfer to the bank account of AKCS d.o.o. Based on the offer/proforma invoice, the order will be processed further after the payment is received.
AKCS d.o.o. will also send the buyer an invoice along with the delivery of the ordered items.
The buyer has the option to collect the item personally at the headquarters of AKCS d.o.o., or they can choose the delivery option within Slovenia during the ordering process. Shipping costs are calculated according to the price list of Pošta Slovenije. The order will be delivered as soon as possible after payment is received. If the delivery time exceeds one month and the buyer does not wish to wait, the buyer can notify AKCS d.o.o., which will remove the item from the order and refund any payments already made by the buyer. In the case that the buyer chooses the personal pickup option, they will be invited to collect the item within two weeks of receiving the payment. Personal pickup is possible during the working hours of AKCS d.o.o. or by arrangement. If the buyer does not collect the goods within one month, the seller will refund the purchase price and withdraw from the contract. In such a case, the buyer bears the shipping costs if agreed upon and executed.
The consumer (this applies exclusively to individuals who acquire an item for purposes outside of their commercial activity) has the right to notify the seller within 14 days of receiving the items that they are withdrawing from the contract without having to provide a reason for their decision. The deadline starts one day after the date of receipt of the items. In the event of withdrawal from the contract, the consumer returns the received item by mail to the address AKCS d.o.o., Ulica Gorenjskega odreda 6, 4000 Kranj. Returning the items to the company within the withdrawal period is considered a notification of withdrawal from the contract. In such cases, the company shall, without undue delay and in any case no later than 14 days from the day of receiving the notice of withdrawal from this contract, refund all received payments, including delivery costs (except for additional costs arising from the consumer's choice of a delivery method other than the least expensive standard delivery method offered by the company).
The consumer must return the item to the seller undamaged and in the same quantity unless the item has been destroyed, damaged, lost, or its quantity has diminished without the consumer’s fault. The consumer is not entitled to use the item freely until withdrawal from the contract. The consumer may inspect and test the items only to the extent necessary to establish their actual condition. The consumer is responsible for any reduction in the value of the goods if it results from handling that is not necessary to establish the goods' nature, properties, and functionality. The only cost borne by the consumer in relation to the withdrawal from the contract is the cost of returning the items. The item must be returned to the seller no later than 30 days from the date the notice of withdrawal from the contract (purchase) was sent. AKCS d.o.o. will refund the received payments to the consumer using the same payment method used by the consumer unless the consumer explicitly agrees to use another payment method, provided that the consumer incurs no additional costs as a result.
Before accepting the goods, the buyer is obliged to visually and quantitatively inspect them and note any visible damages to the packaging or goods.
Under the conditions listed in the Consumer Protection Act, AKCS d.o.o. is responsible for any non-conformity of goods that exists at the time of delivery and becomes apparent within two years of the delivery of the goods.
The goods are considered compliant when they match the description, type, quantity, and quality and have the functionality, compatibility, interoperability, and other characteristics required by the sales contract and when, if applicable, they meet other requirements under Articles 72 and 73 of the Consumer Protection Act. It is presumed that non-conformity existed at the time of delivery if it becomes apparent within one year of delivery unless the seller proves otherwise, or if this presumption is incompatible with the nature of the goods or the nature of the nonconformity.
The buyer may request from AKCS d.o.o. to bring the goods into conformity free of charge, reduce the purchase price in proportion to the non-conformity, or withdraw from the sales contract and request a refund of the amount paid (in this order). The consumer may exercise their rights under non-conformity if they notify the seller of the non-conformity within two months of the day the non-conformity was discovered. In the event of non-conformity of the goods, the buyer should contact AKCS d.o.o.
In the notification of the defect, the buyer must describe the defect in detail and allow AKCS d.o.o. to inspect the item. The buyer can notify AKCS d.o.o. of the non-conformity in person, for which the chamber will issue a confirmation. If the existence of non-conformity is disputed, AKCS d.o.o. will inform the consumer of this in writing within eight days of receiving the consumer's claim. When the buyer withdraws from the sales contract, AKCS d.o.o. will refund the amount paid to the buyer immediately but no later than eight days after receiving the goods or proof that the consumer has returned the goods. If the buyer requests a proportional reduction of the purchase price, AKCS d.o.o. will refund the portion of the purchase price within eight days of receiving the request for a proportional reduction of the purchase price.
The suitability of the goods for normal use is assessed according to the usual goods of the same type, taking into account any statements regarding the characteristics of the goods made by AKCS d.o.o., especially through advertising, product presentation, or statements on the goods themselves.
AKCS d.o.o. must respond in writing to the consumer’s request no later than eight days after receipt if a defect in the goods or services is disputed.
AKCS d.o.o. is committed to permanently protecting all personal data of the user in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and the Slovenian Personal Data Protection Act (ZVOP-2). Detailed information on the processing of personal data can be found here. The user must be aware that they are obliged to provide the online merchant with their personal data in the correct and truthful form, and they are also obliged to notify the online merchant of any changes to their data. By accepting these terms, the user confirms that the personal data they have provided is correct.
AKCS d.o.o. strives to the best of its ability to ensure the timeliness and accuracy of the data published on its web pages. However, the characteristics of items, delivery time, or price may change so quickly that AKCS d.o.o. may not be able to update the information on its websites in time. In such cases, AKCS d.o.o. will notify the buyer of the changes and allow them to withdraw from the contract or exchange the ordered item. AKCS d.o.o. can withdraw from the contract only if an obvious error is found (Article 46 of the Obligations Code). An obvious error is considered an error in the essential characteristics of the item, and all errors that, according to commercial practices or the intent of the parties, are considered decisive and would not have been confirmed or the contract concluded by AKCS d.o.o. if it had known. This also includes obvious errors in the price.

AKCS d.o.o. assumes no responsibility for:
- Internet outages,
- service outages resulting from incorrect use or lack of knowledge on how to use the service,
- service outages caused by the network failure of contracting partners, power outages, or other technical disruptions that may temporarily interfere with the use of the service,
- the use of the website in violation of generally known rules for safe internet use,
- any undesirable consequences the user may suffer due to the incorrect use of the website.
AKCS d.o.o. respects the applicable Consumer Protection Legislation, strives for the amicable resolution of any disputes, and endeavors to fulfill its duty of providing an effective complaint-handling system. In accordance with legal norms, AKCS d.o.o. does not recognize any provider of out-of-court consumer dispute resolution as competent to resolve consumer disputes that a consumer may initiate under the Out-of-court Settlement of Consumer Disputes Act. AKCS d.o.o., as a provider of goods and services enabling online sales within the territory of the Republic of Slovenia, publishes an electronic link to the platform for online consumer dispute resolution (SRPS) on its website. This arrangement derives from the Out-of-court Settlement of Consumer Disputes Act, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes, and amending Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.
